§ 18-176. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Building official means the head of the county building department.

    Business organization means any partnership, corporation, business trust or other legal entity which is engaged in construction or contracting with relation to swimming pool construction in the county.

    Depth shall be measured from the top of the deck to the bottom of the pool.

    Local card means a competency card issued by the county to a contractor which permits such contractor to act in the capacity of a swimming pool contractor in accordance with the provisions of this article.

    Nonswimming area means those areas in a swimming pool that generally do not permit normal swimming activities, including swim-outs, steps, and wading areas.

    Qualifying agent means a person who possesses the requisite skill, knowledge, time and experience to actively supervise, direct, manage and control the contracting and construction activities of the business entity with which he is connected and who satisfies the certification requirements of this article.

    Residential pool or swimming pool means any constructed pool, permanent or portable, which is intended for noncommercial use as a swimming pool by not over two families and their guests, and which is over 24 inches in depth and has a volume exceeding 500 gallons.

    State certificate means a certificate of competency issued by the state department of professional regulation under F.S. ch. 489, which permits the certified contractor to act in the capacity of a residential or commercial swimming pool contractor on a statewide basis.

    Swimming pool contractor or contractor means the person who is qualified for and responsible for the entire project contracted for and whose scope of work involves, but is not limited to, the construction, repair, water treatment and servicing of any residential pool, regardless of use.
