§ 18-206. Certification requirements for individuals and business organizations.

  • (a)

    It shall be unlawful for any person to engage in swimming pool contracting unless he has received an appropriate state certificate or has secured a competency card in accordance with the present regulations of the county regulating the issuance of contractors' competency cards and has obtained a permit for each pool to be built from the county building department. If the individual proposes to engage in contracting in his own name, the card may be issued only to that individual. If the applicant proposes to engage in contracting as a partnership, corporation, business trust, or other legal entity, the applicant shall apply through a qualifying agent.

    (b)

    Applicants for the reissuance and renewal of a local competency card shall be made on such forms as may be provided by the county building department, following approval of such forms as may be adopted by the county board. Holders of state certificates may also be asked to provide necessary and relevant information to the county building department.

    (c)

    If any qualifying agent ceases to be affiliated with the entity for which he has qualified, he shall inform the county building department of this fact within 48 hours, and he shall surrender any local competency card that lists his name as the qualifying agent for such entity. The qualifying agent shall then be issued another local card, either as an individual or as a qualifying agent for another entity, upon submitting such information as may be required.

    (d)

    Any business organization that has had its relationship severed with a sole qualifying agent shall notify the county building department within five days of this fact, and the business organization shall have 60 days from the termination of the qualifying agent's affiliation with the business organization in which to employ another qualifying agent. This time period may be extended by the county board upon a showing of good cause. The business organization may not engage in contracting until a qualifying agent is employed.

    (e)

    In addition to such other information as may be required, a qualifying agent may be required to demonstrate that he is capable of and responsible for, and actively involved in, supervising all swimming pool construction engaged in by his company. A qualifying agent with a local competency card will not be allowed to qualify for more than one business organization unless he satisfies the county board that he has the authority and ability to supervise the swimming pool construction for such other companies as he desires to qualify for.

    (f)

    The provisions of this section shall not be construed to prohibit any bona fide owner of any residential property from constructing, remodeling or adding equipment to any swimming pool located upon his property, provided that he shall not be permitted to build more than one swimming pool per residence within two calendar years, and provided that he submit satisfactory proof of ownership to the county building department and that he:

    (1)

    Obtains all necessary permits to do such work; and

    (2)

    Performs and supervises all the construction work done on his property, and receives no compensation for such work.
