§ 70-1.3. Prohibition of animals running at large.

  • (a)

    Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them in this subsection (a), except where the context clearly indicates a different meaning:

    Bellamy Bridge Landing shall include the landing and area adjacent to the Bellamy Bridge and road thereto on the east side of the Chipola River in Section 5, Township 5 North, Range 10 West, including any graded, picnic, landing, cleared or otherwise improved areas adjacent thereto.

    Blue Springs Recreational Area shall include the recreational area in Section 33, Township 5 North, Range 9 West, south of County Road 164 and west of County Road 164A, including any graded, picnic, landing, cleared, or otherwise improved areas adjacent thereto or adjacent to the Merritts Mill Pond in that general vicinity.

    Buena Vista Landing shall include the landing and area adjacent to and to the east of County Road 271 and on waters leading to Lake Seminole, in Section 19, Township 6 North, Range 7 West, including any graded, picnic, landing, cleared or otherwise improved areas adjacent thereto.

    Christoff Ferry Recreational Area shall include all areas on any side of Christoff Ferry between and including all areas used from time to time as boat landings or recreational areas (except that this definition shall not include privately owned property being used by the owner or owners thereof or their invited guests).

    Citizens Lodge or the surrounding lands shall mean and include those lands lying between and bounded on the north by Bales Drive, on the west by Caverns Road, on the east by a line running south from the terminus of Bales Drive to the Chipola River, and on the south by the thread of the Chipola River.

    Magnolia Landing shall include the landing and area adjacent to County Road 280 and northwest of the Chipola River in Section 26, Township 4 North, Range 10 West, including any graded, picnic, landing, under-bridge, cleared or otherwise improved areas adjacent thereto.

    Peacock's Landing shall include the landing and area at the terminus of the graded road to the south of County Road 278 and on the east side of the Chipola River in Section 30, Township 3 North, Range 9 West, including any graded, picnic, landing, cleared or otherwise improved areas adjacent thereto.

    Round Lake East landings shall include all areas on the east side of Round Lake between and including blocks 50, 6, 9, 8, 7, the unnumbered partial block bordered on the south by Lena Street and on the west by Round Lake, and including all areas shown as roadways on the plat recorded at plat book A-1, page 78-A, public records of the county.

    Sand Basin Recreational Area shall include the landing and area adjacent to the Ocheesee Pond in the Southwest ¼ of Section 5, Township 3 North, Range 7 West, and the northwest ¼ of Section 8, Township 3 North, Range 7 West, Jackson County, including any graded, picnic, landing, cleared or otherwise improved areas adjacent thereto.

    Spring Creek Park shall include the parking area, grassed and improved areas, wooded areas, floodplain areas, waters, boardwalks, launching and swimming and picnic areas, and adjoining unimproved lands and waters, located at U.S. Highway 90 and the Merritts Mill Pond Dam, or within ¼ mile of the intersection of the South right-of-way of U.S. Highway 90 and the center point of the Merritts Mill Pond Dam, and including any graded, picnic, landing, cleared, unimproved or other areas within such ¼ mile distance.

    Turner's Landing shall include the landing and area at the terminus of the public graded road on the north side of Spring Creek in Section 14, Township 4 North, Range 10 West, including any graded, picnic, landing, cleared or otherwise improved areas adjacent thereto.

    Within the vicinity of means within 750 feet of any of the areas specifically named in this section, or any portion of such area, provided that there is located within 750 feet of such area, or any portion thereof, any motor vehicle, boat of any kind, ongoing swimming activity, any flotation device, or any other machinery.

    Yancey Bridge Landing shall include the landing and area adjacent to County Road 167 and the southwest side of the Chipola River in Section 34, Township 5 North, Range 10 West, including any graded, picnic, landing, cleared or otherwise improved areas adjacent thereto.

    All other public boat landings in the county shall include all areas located within the county which are used by the general public from time to time as boat landings, except that this definition shall not include privately owned property being used solely by the owner or owners thereof or their invited guests.

    (b)

    It shall be unlawful for any person, and no person shall, allow any dog or other domesticated animal owned by or under the control or supervision of such person to run at large on or within the vicinity of Turner's Landing, Yancey Bridge Landing, Peacock's Landing, Bellamy Bridge Landing, Magnolia Landing, Buena Vista Landing, Blue Springs Recreational Area, Sand Basin Recreational Area, the Round Lake East landings, Christoff Ferry Recreational Area, Spring Creek Park, the Round Lake remaining landings and recreational areas, and all other public boat landings, or Citizens Lodge or the surrounding lands; provided that this section shall not be construed to prohibit the maintaining of dogs or other animals on leashes not in excess of ten feet in length.

    (c)

    Penalty. Any person who violates the provisions hereof shall be guilty of a noncriminal violation as defined in F.S. § 775.08, to be enforced in accordance with the provisions of applicable Florida law with respect to the investigation, prosecution and adjudication of noncriminal traffic offenses. Any person who violates the provisions hereof for a second time, or which violates the provisions hereof which violation causes or contributes to any injury to any person, shall be guilty of a misdemeanor of the second degree as defined by applicable Florida law, to be enforced in accordance with the provisions of applicable Florida law with respect to the investigation, prosecution and adjudication of criminal traffic offenses.
