§ 74-620. Procedures for request of closing or abandonment of county road.

  • (a)

    This section is enacted pursuant to the provisions of F.S. §§ 125.66 and 336.09 and is enacted for the purpose of establishing procedures for persons to follow in requesting a road closing or abandonment under the provisions of F.S. § 336.09.

    (b)

    Whenever any person, other than the board of county commissioners, requests that all or any portion of a street, alleyway, road, highway or other place used for travel be closed and abandoned, the request shall be accompanied by the following before it will be considered by the board of county commissioners.

    (1)

    A pre-application meeting shall be held with the community development director prior to applying for road closing or abandonment.

    (2)

    A completed Jackson County Petition for Road Abandonment, requesting the road to be closed and abandoned, identifying the reason for the request, and signed under oath by the person requesting the action. A nonrefundable application fee as established by resolution of the board of county commissioners. This fee shall be used to defray the expense of inspecting the road in question, and to pay the costs of advertising for a public hearing.

    (3)

    Signed and sealed boundary survey of the area to be vacated with legal description prepared by a Florida licensed surveyor. An unsealed survey may be accepted only where the roadway is surrounded by a single property owner on three sides and a legal description of the road to be abandoned can be provided.

    (4)

    Title searches (owners and encumbrances report) for all affected parcels in the proposed road closing or abandonment.

    (5)

    A list of names and addresses of all parties to the area being petitioned for abandonment.

    (6)

    A list of names and addresses of all property owners within 300 feet of subject property.

    (7)

    A location map showing driving directions from the nearest major road to the site.

    (8)

    Statement from Jackson County Road and Bridge indicating abandonment will not negatively affect access to a public right-of-way.

    (9)

    Statement from the Jackson County Sheriff's Office indicating abandonment will not negatively affect the public interest.

    (10)

    Statement from the Jackson County Fire Marshal indicating abandonment will not negatively affect emergency response to any development.
