§ 82-5. Theft or taking of recyclable materials.

  • (a)

    It is hereby declared that, upon the placing of any materials, garbage, waste items, recyclable items or materials, or any other items into a receptacle which is placed outside of any residence structure or business building for the purpose of delivering same to a waste collector or recycling collector, such items and materials shall be deemed to have been abandoned by the rightful owner thereof and shall be conclusively deemed, for the purposes of this section only, to be the property of the waste collector or recycler serving the residence or business.

    (b)

    No person shall obtain or take possession of, or use or obtain from any person without authorization by the board of county commissioners or by a county franchised or county authorized waste collector or recycler, any materials which have been disposed of or abandoned as waste or recyclable materials by the previous possessor or owner of the materials.

    (c)

    Any person violating any of the provisions of this section shall be punishable in accordance with section 1-7 of this Code.
